These Terms & Conditions are a legally binding agreement between you and Livin’ to the Max regarding your access to and use of our website and any related services, content, products, communications, phone/SMS features, and accounts and membership access (collectively, the “Services”).

5) Purchases, Access, Accounts, and Digital Products

Access:

Accounts & Membership:

For our accounts and membership access, you agree to provide accurate information, maintain the confidentiality of your login credentials, and accept responsibility for all activity that occurs under your account. We may suspend or terminate accounts for violations of these Terms.

If we provide access links, codes, or similar access methods, you agree not to share them and to take reasonable steps to keep them confidential.

6) Intellectual Property

All content provided by Livin’ to the Max (including videos, text, documents, worksheets, designs, branding, and other materials) is owned by Livin’ to the Max or licensed to us and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, resell, publicly display, or create derivative works from our materials unless we give you express written permission.

7) Acceptable Use

You agree not to:

8) Termination and Suspension

We may also block phone numbers, email addresses, IP addresses, or other identifiers associated with suspected abuse, spam, or non-compliant messaging behavior.

9) Third-Party Services and Links

We rely on third-party providers to operate the Services (for example, payment processors like Stripe, marketing/CRM/communications platforms like GoHighLevel, telecom and carrier partners, website hosting, and analytics tools). These third parties may have their own terms and privacy policies. We are not responsible for third-party platforms, outages, delays, filtering, carrier enforcement actions, or the content and practices of external sites we link to.

To the maximum extent permitted by law, we disclaim liability for service interruptions, message delivery failures, carrier filtering, platform downtime, or third-party acts/omissions.

10) Educational and Faith-Based Disclaimer

Our content is provided for educational and faith-based purposes only. We are not providing medical, psychological, therapeutic, clinical, diagnostic, or treatment services, and nothing on our website or in our materials should be considered medical or mental health advice.

11) Phone Services and SMS/MMS Messaging Terms

This section applies to all phone calls, SMS, and MMS sent by or on behalf of Livin’ to the Max using our communications platforms.

11.2 Consent and Opt-In

11.4 Opt-Out Instructions


You can cancel SMS messages at any time by replying STOP to any message. After you opt out, you may receive one final confirmation message, and no further messages will be sent. To rejoin after opting out, reply START (where available) or submit an opt-in form again using the same mobile number. We also honor common opt-out keywords such as STOP, END, UNSUBSCRIBE, CANCEL, or QUIT.

11.6 Delivery, Carriers, and Reliability


Message delivery is subject to your mobile carrier's network availability and is not guaranteed. Message delivery may be delayed or fail due to factors outside our control (including carrier issues, device settings, coverage, or carrier filtering). Carriers are not liable for delayed or undelivered messages.

11.7 Prohibited Messaging Use


You agree not to use our messaging channels for illegal activity, fraud, phishing, deception, harassment, or prohibited content. We may suspend messaging to any number associated with suspected abuse or non-compliant activity.

11.8 Recordkeeping

11.9 No Emergency Use

13) Disclaimers

14) Limitation of Liability

15) Indemnification
